Terms of sale

General Terms and Conditions of Sale

Scope and Acceptance

These Terms and Conditions of Sale apply automatically to all sales of products concluded on the Erotika website. Placing an order implies the buyer’s unreserved acceptance of these terms. Products are intended exclusively for personal or household use and may not be resold professionally.

Product Information and Prices

The essential characteristics of each product are presented on its product page. Prices are shown in euros, all taxes included, taking into account the VAT applicable on the day of the order. Erotika reserves the right to change its prices at any time, but products will be invoiced at the prices in force when the order is confirmed.

Right of Withdrawal and Specific Exceptions (Article L221-28)

In accordance with Article L221-18 of the French Consumer Code, the customer has 14 full days to exercise their right of withdrawal without having to give reasons or pay penalties, except for return costs, which remain at their expense. In the event of a valid withdrawal, Erotika will refund all sums paid, including the initial delivery costs.

MAJOR EXCEPTION FOR HYGIENE REASONS: Under Article L221-28 5° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection.
Consequently, any intimate item (such as sex toys, worn lingerie or opened cosmetic products) whose safety seal has been broken or whose protective packaging has been opened will not be taken back, exchanged or refunded.

Legal Guarantees

Products sold by Erotika automatically benefit from the legal guarantees provided for by French law. These guarantees allow the user to return items delivered defective in accordance with Articles L 211-4 et seq. of the French Consumer Code.

Consumer Dispute Mediation

If a dispute cannot be resolved by our customer service (support@erotika-sex-boutique.fr), the consumer has the right, in accordance with Article L. 612-1 of the French Consumer Code, to use a consumer mediator free of charge in order to reach an amicable settlement. Failing an amicable settlement, the dispute will fall under the jurisdiction of the competent court.
